Flat Fee & Month to Month Membership Options
These LunchboxWax Terms and Conditions, which govern your access to and use of LunchboxWax services, are an Agreement between you and Lunchbox Franchise, LLC, and each of its parents and affiliates (“LunchboxWax”, “we”, “us” or “our”), or between you and any different service provider or franchise owner identified for a particular LunchboxWax salon, service or product.

 

Enrollment
Participants of the LunchboxWax Unlimited Program (“UP”) must be age 13 years or older and a legal resident of the United States to be eligible for participation. Persons under the age of 18 (“Minors”) must obtain their parents’ or legal guardians’ consent prior to participation. By enrolling in the Unlimited Program, you agree (or, if you are a Minor, your parent or legal guardian agrees) to be bound by these terms and conditions (“Terms and Conditions”). To enroll in the Program, you must complete the UP Application. Guests must keep their contact information and pertinent medical and skin care product use information up-to-date and inform their Waxologist of any changes. Multiple UP memberships may be active at the same time. This Program is void where prohibited by law, or subject to change in accordance with applicable law. Eligible services are subject to change.

 

Term of Membership
Membership runs one year from the date of this Agreement. As a “Member” you may receive your covered UP Service(s) anytime you wish subject to salon hours and appointment availability on that day.  While you may come in for your services as often as you like, WE RECOMMEND WAITING AT LEAST 3 WEEKS BEFORE WAXING THE SAME AREA (SERVICE).  MORE FREQUENT WAXING THAN THIS CAN CAUSE UNEVEN HAIR GROWTH WHICH LEADS TO POOR RESULTS AS THE HAIR IS TOO SHORT TO WAX, AND MAY DAMAGE THE SKIN.  WE RESERVE THE RIGHT TO REFUSE SERVICE THAT IN THE PROFESSIONAL OPINION OF A LICENSED AESTHETICIAN/COSMOTOLOGIST COULD INJURE THE GUEST OR IS UNSAFE AT THAT TIME.

 

PAYMENT(S)
Payment, based on the pricing of the eligible Service(s) outlined, is charged to your credit/debit card beginning the day you sign up and renews annually as agreed to in the UP Membership Agreement. You acknowledge that Lunchbox Franchise, LLC and its franchise owners and affiliates are all separate legal entities and that this Agreement is with a franchisee of LunchboxWax and not with LunchboxWax or any of its affiliates.  Service prices and UP prices may vary by location and are subject to change without notice.  Actual discount/savings presented to and discussed will vary depending on personal use and frequency of use differs widely among guests.  Discounts presented are rounded up to the nearest whole percent.  May be subject to tax in some localities and States.  May not be combined with other discounts or offers.

 

Agreeing to LunchboxWax’s Privacy Policy & Email
LunchboxWax values your privacy. Our collection of your personal information and how we use it is governed by our “Privacy Policy,” which you may review by visiting: https://www.lunchboxwax.com/privacy-policy/. Details from your application for Membership (including personal information) will be collected and used for the purposes of administering the Unlimited Program (which may include disclosure to third parties for the purpose of processing and administering the Program) and for marketing and data analysis purposes. By submitting an application for the Unlimited Program, you agree to receive marketing materials and other communications from LunchboxWax. If you do not wish to receive these communications, you can request that they be discontinued by sending an email to info@lunchboxwax.com (these requests must include the reference “Unsubscribe” or by unsubscribing with the provided link in the email).

 

Cancellation
Flat Fee – Memberships are paid in full for one year, commencing on the date of sign up and after the first 12 months, will continue to renew annually until you cancel. After the first 12 months, you may cancel the Unlimited Program by executing the “Cancellation Agreement.”  You understand that you must sign the LunchboxWax “Cancellation Agreement” to cancel your membership. Termination of this authorization must occur at least 15 days prior to the next billing date.  Should you decide to cancel your Unlimited Program, the cancellation will take effect on the next annual renewal date unless otherwise required by applicable law.

 

Month to Month – Memberships are paid in 12 monthly consecutive installments and after the first 12 months, will continue on a month-to-month basis until you cancel. After the first 12 months, you may cancel the Unlimited Program by executing the “Cancellation Agreement.”  You understand that you must sign the LunchboxWax “Cancellation Agreement” to cancel your membership. Termination of this authorization must occur at least 15 days prior to the next billing date.  Should you decide to cancel your Unlimited Program, the cancellation will take effect on the next annual renewal date unless otherwise required by applicable law.

 

No-Show and Late Cancelation Appointments
We require at least 12 hours notice to cancel any appointment, and a credit card number is needed to hold your reservation. Once an appointment is booked – unless we hear otherwise – we’ll expect (and are excited for) you to be there. No-show and same day cancellations will be charged 50% of the cost of the full regular service booked to the card number with which they were held.

 

Additional Information on the Program
By joining the LunchboxWax Unlimited Program, you agree to be bound by the Terms and Conditions set forth herein. LunchboxWax reserves the right to cancel, modify, or restrict the Program or any aspect of the Program at any time. LunchboxWax assumes no responsibility for errors caused by incorrect Guest information. LunchboxWax may revoke any Guest’s benefits at any time if such Guest engages in abuse of the Program or fails to follow the Terms and Conditions of the Program. The interpretation and application of the Program’s Terms and Conditions are at the sole discretion and determination of LunchboxWax. Liability Disclaimer
LunchboxWax and its affiliates and franchisees are not liable to you for the independent professional decisions, services, and advice you receive from licensed aestheticians and related professionals through your Membership.

 

Program Exclusions
The Unlimited Program is not valid with any other discounts or promotions (unless noted otherwise on the Membership Agreement). If LunchboxWax or any of its locations offer a discount or promotion, it would not count as a qualifying service in the Unlimited Program.

 

Additional Terms
Members are financially responsible for all membership dues and related fees. We, on our own or through our designee, reserve the right to collect any and all delinquent dues or fees owed by a Member. If a Member becomes delinquent in payment of his/her dues or fees, We, on our own or through our designee, reserve the right to refer such Member to a collection agency and Member shall be required to pay all reasonable collection costs associated with the collection of such unpaid dues or fees.

 

Member agrees that the Membership Agreement and these Terms and Conditions, and the application and intake forms filled out by Member, sets forth the entire agreement and understanding of all terms and conditions of membership that exist between Member and Us. Member acknowledges that neither We nor anyone else has made any other representations to induce Member to become a member or otherwise participate in this membership. Member understands that Member’s membership is with Us at the salon location noted on this Membership Agreement. Member shall engage in appropriate conduct and decorum associated with the receipt of services at the salon.

 

Member understands that Member’s credit/debit card information will be monitored by our software system, including the date of expiration. Failure on the part of Member to provide us with updated, current, credit/debit card information may result in termination of Member’s membership. Member agrees to timely notify Us of any changes in Member’s personal information, including mailing address, telephone number and credit/ debit card information. Member’s failure to timely report such changes may constitute grounds for termination of Member’s membership. Member agrees to abide by all terms of the Membership Agreement and these Terms and Conditions and all facility rules and regulations for any LunchboxWax salon that Member visits for services.

 

We agree to make the benefits of membership, available to you at all times during the dates of your Membership in accordance with the terms of your membership plan. Unless specifically provided for otherwise, you may only utilize the Unlimited Program (including any related services or programs) at the salon at which you became a Member. We reserve the right to amend or revise the Unlimited Program at any time, in our sole discretion.

 

We reserve the right to revise, amend or alter these Terms and Conditions without notice to Member, and such changes will become effective immediately without further action required on the part of Us or anyone else; subject to applicable law. Membership may be revoked at any time by Us for failure to abide by these Terms and Conditions, and We, on our own or through our designee, reserve the right to discontinue service to any Member that fails to abide by the terms of membership. Upon request, Member is entitled to receive a copy of the Membership Agreement and these Terms and Conditions.

 

Member hereby jointly and severally indemnify, absolutely, irrevocably and unconditionally guarantee to defend and hold harmless LunchboxWax, and their successors, employees, franchisees, affiliates, successors, predecessors, and heirs and assigns, from and against and in respect of any and all losses, costs, expenses (including, without limitation, reasonable costs of investigation and defense and reasonable attorneys’ fees), claims, damages, obligations, or liabilities, whether or not involving a third party claim (collectively, “Damages”), if and to the extent such Damages result from or arise under, or related to, Member’s actions or use of this Membership.

 

Lost or Stolen Items
Neither LunchboxWax, any of its franchisees, any of their affiliates, nor any professional corporations for which they provide management services, are responsible for lost or stolen articles or goods while Member is present at our facility, or any other LunchboxWax salon.

 

The laws of the State of Idaho govern all rights and obligations of the parties under this Agreement. The parties agree that any appropriate state or federal court located in Idaho has exclusive jurisdiction over any dispute arising under or in connection with this Agreement and is the proper forum in which to adjudicate the case or controversy. The Parties hereto irrevocably submit to the jurisdiction of, and venue in, any such court, and hereby waive any objection or defense thereto. THE PARTIES AGREE THAT ALL DISPUTES SUBMITTED TO THE COURT PURSUANT TO THIS SECTION SHALL BE TRIED TO THE COURT SITTING WITHOUT A JURY, NOTWITHSTANDING ANY STATE OR FEDERAL CONSTITUTIONAL OR STATUTORY RIGHTS OR PROVISION.

 

You agree that the resolution, mediation or litigation of any dispute, lawsuit, demand or claim (“Claim”) between you, LunchboxWax and/or its franchise owners shall be conducted on an individual, not a class-wide basis, and that no such litigation proceedings may be consolidated with any other legal proceedings involving LunchboxWax or any other person, member, or legal entity. You further agree that you, and anyone asserting a Claim through you, will not be a class representative, class member, or otherwise participate in a class, representative, or consolidated proceeding against LunchboxWax. We and you agree that the presiding party of any Claim between us may not consolidate more than one person’s (or legal entity’s) Claims, and may not otherwise preside over any form of a class or representative proceeding or claim (such as a class action, representative action, consolidated action or private attorney general action). The foregoing shall constitute a “Class Action Waiver.” In the event this Waiver, or any portion thereof, is adjudged illegal or unenforceable, then any Claims will be decided by a court of competent jurisdiction as set forth above.

 

Referral Program
No purchase necessary to participate in the LunchboxWax Referral Program.  All referral programs are administered by the local salon and referral credits vary by salon.

The program is void where prohibited by law.

By any participation in the referral program, you agree to receive marketing materials and other communications from LunchboxWax. If you do not wish to receive these communications, you can request that they be discontinued by sending an email to contacting us or by unsubscribing with the provided link in the email.

Referral credits may only be used for waxing services and may not be combined with any other promotion. Referral credits may not be transferred or exchanged for cash.
